Georgia Railroad Protective Liability Insurance Information
Contractors must purchase Railroad Protective Liability Insurance to
hold a Railroad company harmless for injury or damage arising out of
the contractor's work on or within 50 feet of a railroad.
The Railroad Protective Liability Insurance policy does not protect the
contractor... it protects only the Railroad company. The Railroad
company is the "named insured" on the insurance policy. A Railroad
Protective Liability Insurance policy also stipulates that the Railroad
company is protected for acts or omissions arising out of the "work"
at the "job location".
The size and the complexity of the contractor's
construction project usually determine the policy limits
required by the contract. Liability limits of $2 million for
each occurrence and $6 million annual aggregate
limits are common for a Railroad Protective Liability
Insurance policy.
